GHS:

GHS is short for Globally Harmonized System of Classification and Labelling of Chemicals.

 

CLP (EU-CLP: Regulation (EC) 1272/2008)

The full name of EU-CLP Regulation is Classification, Labelling and Packaging of Substances and Mixtures Regulation.

The EU-CLP Regulation remains connected with the GHS and it is the specific expression of the GHS in Europe. At the same time, the EU-CLP regulation and EU REACH regulation are supplemented each other.

The ultimate text of the EU-CLP regulation consists of the GHS about the classification and labelling stipulation of the chemicals. It plays a reinforcing role in REACH regulation and supplies relevant regulations to establish the data of classification and labelling of registration of materials for the ECHA.

The new EU-CLP: Regulation (EC) 1272/2008 carried our on 20th Jan. 2009. The EU-CLP regulation carries out the regulations of the GHS. It will instead of the original two directives: Directive 67/548/EEC and Directive 1999/45/EC step by step.

From 1st June 2015, the EU-CLP regulation (Classification, Labelling and Packaging Regulation) will become the only law and regulation to the classification and labelling of the substances and mixtures.

The implementation of this law and regulation marks that the enterprise should comply with the requirements of the EU-CLP as well as the regulations of the REACH. According to the fourth stipulation of the CLP regulation, if the substance and mixture (preparation) do not comply with requirements of the EU-CLP, the substance and mixture can not be put on the European market.

 

On 1st June 2013, the EU issued the laws and regulation No. 487/2013. It is accordant to the 4th revision of the GHS and revises the EU-CLP (EC) 1272/2008. The main change contains as follow:

1. The unstable chemical gas and non-flammable aerosols belong to the classification of hazardous goods.

2. Using reasonable warnings.

3. It abolishes the labelling requirement of the corroding metal for material classification, but excepting the products which contact with skin or eyes.

4. To the product which capacity is not more than 10ml, it should reduce its inner packing labelling. It’s only for the products which have the full labelling on its outer packing. Or this substance and mixture is only used for scientific research and development as well as quality control analysis.

 

The effective dates of these requirements as follow:

A. Substance: it is put into effect on 1st Dec. 2014. Excepting the following conditions:

The substance has been classified, labeled and packed correctly according to the laws and regulations (EC) No.1272/2008 and has been circulated on the market before 1st Dec. 2014, so it needn’t to be reclassified, relabeled and repacked on the basis of the new EU laws and regulations No 487/2013. This transitional period ends on 1st Dec. 2016.

B. Mixture: it is put into effect on 1st Jun. 2015. Excepting the following conditions:

The mixture has been classified, labeled and packed correctly according to the laws and regulations (EC) No.1272/2008 or 1999/45/EC Directive and has been circulated on the market before 1st Jun. 2015, so it needn’t to be reclassified, relabeled and repacked on the basis of the new EU laws and regulations No 487/2013. This transitional period ends on 1st Jun. 2017.
